I recently was placed into the Work Related Activity Group following my Tribunal, having previously been found fit for work by the DWP. However, the Tribunal Judge ruled that Regulation 35 did not apply in my case. I therefore requested the Statement Of Reasons For Decision, together with the Judge's contemporaneous notes.

I have now received all of the requested information, which arrived in just 2 weeks of my original request.

The Judge's contemporaneous notes and the Decision Notice have hand written numbers in the top corner of each page. This clearly relates to these documents being placed into the appeal paperwork bundle. However, the Statement Of Reasons For Decision does not have any such hand written numbers, indicating this document has not been placed into the appeal paperwork bundle.

My question is this. As I requested the Statement Of Reasons For Decision from the Judge would this document have also been sent to the DWP, or just myself?

The reason for asking this question. The Judge has stated that not only does Regulation 35 not apply, but he believes I could perform any of the tasks that being in the WRAG coud ask of me. I have no issue with the DWP having the Judge's contemporaneous notes as his handwriting is virtually impossible to read.

I am concerned that when I am called in for my first Work Focused Interview the Judge's Statement Of Reasons For Decision could be used against me.

Yes, the DWP will have received a copy of the SoR.

I would not expect the Judge's comments to have any influence over the DWP's actions, if you have been placed in the WRAG then you are subject to the activities expected of someone in that group, although the limitations resulting from your conditions must still be taken into account.
