Hello, I am a new member and not quite sure yet how this all works.
My husband has had his claim transferred to pip. He was on the full entitlement of incapacity benefit for six and a half years. He went for his medical and was told he was not entitled to pip. Of course we did the mandatory appeal. And that came back he was put on the standard rate. So he lost the car. Above all he needs the car to get to hospital. Doctors, and other appointments he may need. Not to mention getting out of the house to release his depression.
He suffers from osteoarthritis. He has severe nerve damage in his spine. Two full knee replacements, to which he has never recovered from. His legs are constantly swollen, also cellulitis in both his legs. His feet are deformed, and waiting to have a toe amputation. He has not worn shoes for 10 years. He wear hospital shoes, open toe.
He suffers with depression. And can not walk up and down stairs before getting out of breath.
I have to help him dress, wash. He can not bend. He is in constant pain. Amongst all his medications he takes morphine.
So to be told he is not severely disabled has made his depression worst.
I just wanted to know if he can still appeal has the time limit to do so has lapsed.. we have to give the car back in March .

If you have completed the MR Process, the next stage is for your husband to appeal.

Our PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Your request needs to be with the Tribunal Service within one month of the date on the letter notifying you of the MR Decision, if it is late then you will need to provide reasons for the delay on the form.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
