Hi,
Got my brown envelop today went from mid care low mobility to NIL points!!
Not really surprised given other people's results but one thing really get me.
The assessor stated that i had no issues with the musculoskeletal examination..... I didn't have one.
Do they do this just by watching you?
She also stated that i could walk 200m as i walked 6m in my home even though i stated on my form that my pain only starts after a few minutes... i only walked across the room to see her out which was about 3m at most.
I'm applying for a reconsideration but don't feel hopeful
Has anybody any comments about the musculoskeletal examination?

Unfortunately we have seen the "phantom" examination before.

Although it may seem counter-intuitive, I would ignore it for the moment, the most important thing you need to do is to make sure that you have show that you meet the legally defined criteria for an award, then deal with the issues in the report.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

thanks Gordon,
I phoned today and asked for a copy of the assessment so i can see what exactly what she recorded.

But just another query....
when i phoned the advisor asked had i applied for the MR
I said I was going to but was going to do so in writing.

She told me to ring before my month was up and register by phone my request for the MR and I would then be given another month from that date to return all in writing so I would have time to get paperwork together and see an advisor.

From what i have been reading here I thought it was only 1 month in total.. is it maybe different as i'm in N.Ireland or did she give me the wrong advise?

You have one month from the date of the Decision for the DWP to receive a request for an MR, in addition, if you request it, the DWP should then give you a further 28 days to provide additional information in support of your MR, the time runs from the date of your MR request and includes postage time so in practice it needs to be with the DWP within three weeks.

Surprisingly my f2f report I requested came today.. within 2 days.
It would be hilarious if it was not so full of contradictions and lies.
My msk assessment included me standing on one leg and gripping her fingers... Basically according to her acrobatics.. I never once touched her not even to shake her hand and I only walked her out after the assessment at home!! But I did lift my Id off the chair beside me this this showed I have no problems with my grip!!
It's going to be so hard to ignore this issue and just deal with the descriptors.
The good thing is she contradicts herself throughout.
But what really got me was that the assessor, a physiotherapist, stated that as I'm on medication for my mental health issues there's no way they could affect me in my everyday life.

Basically as I understood how the assessment worked, I worked within the health department for years in rehabilitation and often filled out benefit forms and reports, and hold a masters I basically couldn't be effected by mental health even though I'm under a physiatrist.

And to add a cherry to the report they have the cheek to sign it under the statement this report contains no harmful information!!

I'm presently trying to get an appointment with cab to do the MR but I'll let you know how I get on and thanks for all your guides and the chance to moan lol

Just when you thought things couldn't get any worse....

I decided to use linkedin just to see the background of the physiotherapist who carried out my f2f under mental health issues...

She has 5 years experience as an ANIMAL PHYSIOTHERAPIST! !!

She qualified as a physiotherapist but then went into animal physiotherapy.

She advertises her services for horses... you couldn't make this up.
Hubby says it could be worse she could have taken my temperature

At least I have another thing in my corner when I get to appeal
