Hi all I haven't posted on here before but been a member on and off for a couple of years now. so a brief history of my circumstances are that in 2007 I was awarded the higher levels of DLA for an indefinite period, and like everyone else have had to go through the indignity of applying for PIP. this was fine and I used the guides to help hover I was only awarded higher rate daily living and therefor had to hand back my mobility car. now at the time I did not oppose this as I was awaiting the arrival of a letter from spinal neurologist and my award was to be reviewed in a year. it took nearly 6 months for the letter to arrive so I though that I would just wait and send it in with the review stuff. sure enough the review application arrived and again using the help from this site I submitted the forms along with the neurologists letter that states that I have a very rare and inoperable spinal condition and of course all the other up to date medical stuff as well. I thought that the neurologists letter alone would be proof enough and I would get my full reward back. well they sent an ATOS nurse to my home to assess me and lo and behold when my award letter arrived I was amazed to read that my award had been reduced from enhanced daily living to standard. I was even more surprised to read the the decision makers report. so I asked for a copy of the ATOS report that turned up a few days later. Well there wasn't a grain of truth in it and the nurse had lied and made most of it up she had also copied and pasted sentences from the previous ATOS report that had been done as a part of my migration to PIP. these sentences were also untrue and I had pointed this out in my latest application along with my reasons for not contesting the original PIP decision. So anyway I have today sent of a large envelope of stuff for the mandatory reconsideration that I requested. this included a list of 22 points that were either incorrect or worded in such a way as to be derogatory, complete lies or points that have been deliberately left out. I also enclosed a CD copy of the covert recording I made of the ATOS assessment along with a full transcription of the recording these proving that the whole thing was a complete sham. so it will now be interesting to find out what the result of my mandatory reconsideration will be. I apologies for going on so long but I feel a lot better for telling you all this.

Please do not forget that awards are made by the claimant showing that they meet the criteria for so I hope you have dealt with this in your MR request.

Well I hope I have covered all of the requirements, I went through each of the descriptors stating why I thought the points awarded were incorrect but it wouldn't surprise me at all if nothing changes or if it does changes not for the better. The decision makers explanation in the award letter included statements from the ATOS HP report that I hope I have managed to proved were completely fabricated. I also sent in a copy of a medical assessment report that was done for the DWP for ESA last year and this report is the polar opposite to the ATOS report. Funnily enough it took 5 separate requests and a threat to write to my local MP before they would send me the copy of the ESA report and so it was not available to submit with the review application and only turned up last week. I will be interested to see how the DWP react to two completely different medical reports that were both commissioned by them. The thing that most got my back up were the shear amount of lies told by the ATOS HP. She had said I can walk 50mtrs but no more than 200mtrs but I had told her and she actually witnessed me struggle with 15ft. she failed to mention in her report that I fell while undertaking the physic part of the assessment and she never asked to see any identification to prove who I was before, during or after the assessment. all this and more can be proved by listening to the recording. sorry to waffle on but as i said before there were 22 separate issues of her either lying and making stuff up, or twisting what I said, some of which appears numerous times throughout her report. But I suppose all I can do now is wait to see what happens and start to prepare for the appeal. I would be grateful if anyone could tell me where I need to send an official complaint about this particulate ATOS HP?

Well here's an update to my mandatory reconsideration request. I have now been awarded enhanced daily living and awarded standard mobility for 3 years. so was well worth doing.I would urge everyone to secretly record their medical assessment as for me this proved to be invaluable in proving the dishonesty of the ATOS assessor and a big thank you to benefits and work for all the help from the guides
