Hi, Are there any guides or information to help with sending a request to the Lower Tribunal for permission to appeal to the Upper Tribunal (PIP) please. Thanks.

Where are you in the process? Have you requested a Statement of Reasons from the Judge at your hearing?

Tribunals – Requesting a Statement of Reasons

If you have received the SoR then there should be a pamphlet explaining how to proceed further and a form for you to request a further appeal.

I'm afraid you won't find any guides for detailing your reasons for appealing, every case is unique and requires access to all of the papers used in the appeal as well as the SoR and RoP.

An appeal to the UTT is based on your showing that there has been an Error of Law in the making of the Decision at your recent Tribunal, not whether you disagree with the Decision that was made.

Thanks, Gordon. Yes, I've requested the statement of reasons and received that. My local Citizens Advice and local Disability Solutions both agreed that the Tribunal's decision that a Continuous Glucose Monitor for someone who is hypo impaired (as I am) should be deemed an aid or appiance but the Tribunal decided that it was for 'peace of mind'!!

I think there are other points of law, like disregarding evidence at every point but it would be helpful to have the input of someone who has legal experience of points of law in regard to appealing PIP decisions.

Apparently, I can also ask for the Judge's notes of evidence but I only found this out by reading a CAB training document.
I must admit if I could afford to live at all without PIP, I would give up at this point but I cannot so I must once again plough through the 100+ pages of the document bundle ! :(

Any information to useful guidance, links or free legal advice would be much appreciated.
