My son gets higher level PIP, Income related ESA and Industrial Injuries benefit. Every penny he gets from IIB is taken off his ESA. He is appealing the low level of IIB he receives but we are worried that if he gets more and they end up taking all his ESA would he still get the Severed Disabilty Premium or could they take that too? if so we might be better off dropping the IIB appeal. I would really value any help

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

Here's the problem, his ESA amount is based on the amount that the Government believes he needs to live on, I'll not get into a discussion with whether this is reasonable or not. The IIDB is treated as part of this income so as the IIDB increases the ESA will go down so that he still receives the same amount of money.

The SDP is part of his ESA payment and so it will be eroded if the IIDB goes up, there is nothing you can do about this.

Rather than looking at the SDP being lost, consider the total income he might receive, if you think that a higher rate of IIDB will deliver more income then you should consider going down that route, whilst his ESA payments might stop, he will remain entitled to ESA and will receive NI Credits which count towards a full State Pension.
