Hi can I just ask a question about myself and daughter. I’ve been on dla indefinitely for 18 years then changed to pip last year, I’ve got back failure due to many operations over the years. I’ve just had a temporary implant done called a nerve root stimulator fitted for 10 days to see if makes any difference to my pain. It’s not granted to work for everyone, if it did work and eases the pain how do I go on with my pip .will I loose my benefits even if it eases it slightly . I take morphine and many other tablets which doesn’t take all the pain away. If the trial works then I could be offered the full implant which really just masks the pain . I would be greatful for some help.

Next question is my daughter is hearing impaired from birth has two hearing aids which she is a reluctant wearer when not at school. She has been on dla since been young high rate care low rate mobility.
She also got a diagnosis of autism in 2011 with severe learning delays , she’s 12 but only got a learning age of a 4year 7 months. About 2 years ago I reapplied to see if she could get high rate mobility but it was turned down, she’s got no sense of danger will run off or the opposite sit down and not move , couldn’t make a route herself as she hasn’t got the understanding of the levels. So her dla is based on her hearing impairment. Also she had a blue badge but when I came to renew it two years it was declined and said that autistic children couldn’t have them no more . Has this now changed we’re they can reapply for a badge. Thank you I await your reply . Dawny

If your conditions are improved by the implant and as a result of this the Descriptors that you met for your award might change then you are required to notify the DWP of a Change of Circumstances.

If you do then your claim will be reassessed, this may still make the same award as you currently have, but it could also reduce it or even remove it depending on the points you previously scored.

I think that you will struggle to get the Higher rate of Mobility for your daughter. HRM is all about her ability to walk, she would need to meet the following;

1. Due to a physical disability the child is unable to walk. This relates to children who cannot walk even a few steps due to a physical disability.
2. The child is both deaf and blind. This relates to children who have 100% degree of disablement resulting from loss of vision and 80% degree of disablement resulting from loss of hearing, and who cannot walk outdoors without another person.
3. The child has no legs or feet (from birth or through amputation).
4. The child is blind or severely visually impaired. The child must have been certified blind or severely sight impaired and must meet certain additional criteria relating to their degree of visual impairment.
5. The exertion required to walk would lead to a danger to life or serious deterioration in the child’s health. The danger to health has to be caused by the physical exertion, so could for example apply to a child with a very serious heart condition. This criteria does not apply to children whose behaviour causes danger.
6. The child meets the ‘severe mental impairment’ criteria.
7. Due to a physical disability the child is ‘virtually unable to walk’.
