Received decision but pathetic 2 tra award was created by Roxy raver
Hi Gordon
Just an update so after waiting 7 1/2 months for my DLA to PIP decision I could wait no more so today I called DWP as nothing in the post today.
A very nice gentleman adviced me a decision had been made on March 1st and letter sent out
I asked if he could tell me over the phone which he said he would so with baited breath I listened.
I've been awarded Enhanced Care he said but no mobility I said are you sure now crying !!
My medical report I have awarded me 12 points for mobility so how can that be ?
He looked again and said yes you have been awarded 12 points there must be a mistake he said.
Went away and checked came back and said we as in DWP have issued you an incorrect decision letter you have been awarded Enharnced for both and I will get an amended letter ignore the one which will arrive anyday now.
Then asked how long the award for ..... 2 years he said to which I burst into tears again!!
So previously a life award for DLA but now a pathetic 2 year award which took them over 7 months to make !!!
I am awaiting the decision maker calling me back .........
Where do I stand with regards to a MR ?
Can I ask for a MR based on the award length ? Or is this not allowed ?
Or do I shut up and except this pathetic decision?
I've been ill since I was 3 I'm now 47 so in 44 years I've seen no improvement and won't so how on earth can I be given such a short award.
I will tomorrow call the decision maker if she/he doesn't call me but could you advise what do I say or give me a few pointers please.
The award is from 21st March so technically March 2019 I'm going be asked for a review .
Please advice before I throw myself under a train !!!
As always thanks for your advice

First of all congratulations on the award.

The award length is part of the Decision and is therefore subject to challenge. We have seen mixed results in the forum, I know of only a couple of members who have been successful in just challenging the award length and a couple more when challenging the whole award. There have probably been about twice as many who have failed to get the length increased.

I realise these are relatively small numbers but it does not appear to be an issue that is raised very often as I have seen even less talk about it on other forums than are own.

Thanks for your reply tomorrow when I call I can all but discuss it and see what he/she says.
My argument being that I will not improve so how can I have such a short award also that the comments mentioned in my assessment report I feel are not accurate.
Surely a condition which won't improve but remain on a gradual decline merits a longer award ?
Also would I be in my right to complain about the time taken 30 weeks !!
Any advice appreciated

Your arguments are sound but it is the Government's intention to reassess PIP claimants on a regular basis and DM's take this to heart.

As to a complaint about the length of time for a Decision to have been made, there is no set time for this to be completed within so it's difficult to see want it would achieve, you might be better contacting your MP.

Thank you Gordon
I will see how th DM comes across I take on board the fact they can take as long as they want
But I will point outwithout rocking the boat as such that 7 1/2 months to make a decision has caused me considerable distress and to only be given 2 yrs and also the fact that even then they can't even send out the right decision.
Can you imagine if I hadn't called today and tomorrow the envelope arrives someone with severe mental issues might have reacted very differently to how I would / did !!

I too got 2 years after having an indefinite DLA award. I have several letters from hospital consultants saying my condition is permanent & it has been since 1990.

After all the stress and worry of changing to PIP, I decided to take what I had been given, rather than risk losing everything. Like investments, if you appeal, your aaard can go down as well as up. It leaves a bitter taste in the mouth, but personally if you’ve been successful in getting PIP, I’d swallow the pill and keep quiet.
