Obtaining specialist's letters.. how? was created by LaurenB
PIP advisor told me they will not write to my specialist for further information and I would have to do so myself. So I did. This is the reply I got from my specialist:

I do appreciate you requirements, I really do, and I also have read what ATOS have said to you and I also see what you are trying to achieve but from an information governance point of view, one cannot simply write a letter addressed, ‘to whom it may concern’. In order to protect my 30 year career that would be put at risk if I inadvertently broke information Governance, I appreciate the time scale but as with ALL of these requests, I cannot proceed unless I have a letter from ATOS, specifically requesting the information. They SHOULD know this and it is unacceptable of them to ask you to chase around for information.
The bottom line is, ATOS need to write to me. There is no other way.
Please be assured that I am not trying to be difficult or obstructive, these are the facts of the matter.

I need the specialist to put something in writing... they have refused my written request and to fill in the GP tick box form. Any ideas on how to proceed? I scored straight zeroes in my assessment due to a lack of medical input but it's pointless going for a mandatory reconsideration without medical proof.

I'm afraid it sounds like yo are being let down by everybody offloading responsibility to someone else.

Three ideas which may offer a solution

Ask your Consultant to write to you.

Ask your GP to ask your Consultant to write to them

Lastly get your MP involved maybe they will have leverage

Softly, softly catch the monkey.... I have sent a polite reply informing them of their mistaken idea that ATOS have to apply for the information and I have the legal right to do so myself as long as I give my full consent for associated disclosures.
This is what I found on the nhs pages re information governance: www.england.nhs.uk/ig/about/ "Generally speaking, people within the healthcare system using data for secondary purposes must only use data that do not identify individual patients unless they have the consent of the patient themselves."
I have also supplied the name of the decision maker so there is no need to address any info to "whom it may concern" (a valid point).
If the reply is still negative, I will ask my GP to intervene.
I will keep the post updated.

Hi
My GP puts the following at the start of any letters or reports I have needed. He always addresses the letter/report to me.
"I am writing this letter at your request following our recent conversation. It is addressed to you to cover the aspect of consent for me to do such a report. i am happy for you to show it to whoever is appropriate in your case. The rest of the letter may be taken as my report."
The report details then follow.
Maybe your specialist could do the report to you?

after my last email, I received a note saying my request has been reconsidered and apparently they will supply the info I have asked for! I wait to see if it actually happens, but as they will charge up to £50 for the favour I expect it might.
