Advice on DWP presenting evidence to a tribunal was created by Tc
A friend of mine has a tribunal on the 30th may, In relation to pip, She has suffered with heart problems since 2007 after a heart attack, In the response made by the dwp to the tribunal they report that it was confirmed via phone call to her doctor that she has cardiac disease and she was discharged from cardiology in 2008, What they don't mention is that she has been receiving ongoing support and has attended heart clinic since and continues to attend when required. My point is can this evidence stand in a tribunal as its not in writing from the doctor, They may have had this phone call but they certainly haven't included all the conversation and are misleading the tribunal

My mistake it was the capita (HCP) who reported she had spoken with the doctor, Over the phone about her heart condition. Their report is in submission to the appeal. I am just unsure if that could be used as evidence against her. I thought evidence needed to be documented and signed by a GP for it to stand in court ?

If they are continuing to receive treatment and/or support then they should have appointment letters for this that they could include as evidence.
