Time DWP consider medical evidence was created by Poppy
Hi can you help. I have been awarded nill points as says no depression, etc. What is the time scale that they take evidence into consideration. My medical evidence was 1 year old. Would they still use it. Also at MR and appeal do they consider how the decision has affected the applicant, and medical evidence dated after the decision date.
I have an operation on Wednesday but now I have been devastated by decision and depressed I have cancelled my operation due to depression, which apparently I haven't got and I am stable according to DWP.
Can the appeal evidence collected be included before decision (how far back) and after the decision, but for how long after decision. Not sure whats valid and not thanks

They should accept any evidence that is less than two years old without problem bit I would always advise that you bridge the gap between the evidence and when you completed the claim form, so are you better, worse or the same.
An MR or appeal can only take into account how you were at the time the Decision was made, any changes since then cannot be considered.
You can supply new evidence but it must make it clear that it refers to when the Decision was made or you risk it being excluded.
