Hi,

I need to appeal an ESA decision and have managed to get some help from welfare rights in my area. When I made the appt. they said I don't need to do anything, just sign the forms they give me, they take it from there (don't even need to attend tribunal).

Initially this felt like a massive relief as I've been struggling how I'm going to do this due to health/housebound. However, I'm feeling a bit concerned about what I'm going to be asked to sign....I was hoping to get someone to help me and represent me at appeal, but worried I'm signing away my rights to manage own affairs re DWP.

Would you an idea of what I might be asked to sign, what it means ie. is it just about appeal/ does it relate to my ESA claim just now, or also going forward/ is it all my business with DWP eg. re other benefits, mail/forms

I would really appreciate your guidance on this as, I'm worried I'll feel pressured to sign something because I really need the help and won't really have time to think in the moment.

The starting point for an appeal is the claimant submitting an SSCS1 form to the Tribunal Service, so I think it likely that this is what they are going to ask you to sign with them as the Representative.

I have to say that I am quite worried by what you have been told, most Welfare Rights organisations are stretched to breaking point and we regularly hear from members who have been let down by their Reps as they approach the hearing or even on the day.

I think you need to get a better understanding of what they are offering to do and when.

Ultimately this is your appeal and only you benefit or lose by it's success, a failure to have proper representation would not be Good Cause for an adverse Decision to be overturned.
