UC Transitional protection help pls! was created by leapoffaith
Hello..
I read your newsletter today.. I live alone & receive severe disability premium & am in the support group of esa.. I live over 100 miles from my mum & sister which distresses me greatly.. Also my mum has recently had a stroke & my sister lives with her in a very small 3 bed house.. The house is tiny & for many reasons it would be hard to manage together.. It did seem good news though that if i did have to move in with them i would have transitional protection because they live in a full UC area.. My question is hard to phrase.. I am alone with the premium now but if i had to move in with them because of mums health or mine then i would no longer be living alone.. Does this mean i would not be protected? Also mum owns the house so i would not claim housing benefit.. Basically would i lose transitional protection & also be put on UC & classed as change of circumstances? I am so worried about my mum & was consoling myself that my benefits would not change.. Would i only be protected if i move to somewhere & still live alone? Hope i make sense..
Best wishes

There are actually two issues;

If you move in with your mother and sister then you will no longer be living alone unless they both have a qualifying benefit such as DLA or PIP, you will therefore no longer qualify for the Premium.

You will only have to claim UC if you need to make a new claim for one of the benefits that are covered by UC. Nothing in your post suggests that you would need to do this.

If you move to the area AND live alone AND do not claim any new benefits such as Housing Benefit then you won't have to claim UC and you would continue to receive your SDP.

If you do have make a new claim for a UC benefit then at the moment you would lose the SDP. Whilst the Minister has announced changes they have not been made yet, our understanding is that claimants who have lost their SDP will be recompensed but as of today we do not know how this will be done.
