Thank you B&W again, daughter's Tribunal this month was much more intimidating than three years ago, with a DWP presenting officer who arrived at the last minute which was very distressing as we had been told it didn't look like one was coming. Plainly judge had read much of 400 page bundle and questioning was both aggressive and inconsistent. It was pointed out we needed to address daughter's Daily Living and Mobility problems as of August 2017 when the decision was taken to award only standard rate after the February review. Then they started on at her as to why she wasn't currently doing the now-discredited Graded Exercise Therapy [GET] that was suggested two-three years ago. Then verbally prodded her about the recently-bought secondhand Fitbit she was wearing-advice[/i]-remove any such gadget as it may be misinterpreted as meaning you are really all sporty and capable, rather than desperately trying any way to help yourself when every step hurts.
However we did, in the post, get back the Enhanced on both but not the extended award we had requested due to the bad effect on her health, attested in two medical letters, of nearly constantly being in the process. So award until Jan 2020, just waiting now to see if DWP will follow their previous form of slapping a review 12 months prior which would mean just 4 months 'off' and a form to do over Christmas..
anyway at least she can clear her overdraft, but has been forced to move house to cut costs in the meantime. By the way how come DWP don't have to pay interest when it takes over a year to process a review, and 11 months from you losing the money before you get it repaid???

It usually takes the DWP 5-8 weeks to process a Tribunal result, if you have not already done then contact the DWP to make sure that they have received the Decision Notice.

As to the interest, all I can suggest is that you ask you MP about this. You can pursue the DWP for compensation but you would need to show that their original Decision was made in error and not incorrectly.

DWP have already actually paid daughter-from Tribunal 6th July. At the moment letter does not mention an early review. So relieved they have not decided to appeal against First Tier Tribunal or just be slow acknowledging and paying. Thanks again for all the encouraging guidance in the members' downloads.
