Hi James here I’m reading with interest the members comments on the above.
No one has yet to ask the following
If ones spouse is being reassessed for cont based employment and support allowance
will my occasional pension be taken into account in what she will be awarded.
They stay on there letter that she may be entitled to Income related ESA and I’m aware my pension will effect what she gets on that.
But on the contributions based employment and support allowance I’m not sure

Contribution Based ESA claims are made in the name of the claimant only, their pension will be considered but not a partners.

Thanks Gordon my problem with all this is that as my spouse has been on contribution based Employment and Support group.She has received this ESA3 form to complete with the letter stating that : we need to look at your claim to decide if you might also be eligible for income related ESA from 25th Sept 2012 to see if she is entitled to any extra benefits called premiumsI think
on this ESA3 they are asking for all my personal financial details and from what I am reading I can see that my pensions and savings will be taken into account. with her details do I have to put in my details.
I`m not sure just what to do, can this be completed with just her details do I have to put in my details.
Can we ring them and tell them that the situation should stay as it is or is this mandatory for them to do this, they sent this form which states on the first page of the form under ( Why we have sent you this form) you have told us about a change in your circumstances or you want to claim income related employment and support allowance when we have not said or told them any such thing there has not been any changes except to her medical condition which has got worse.
Your advice would be most welcome as I think they are at they are at their work they seem to be trying get my wife onto the income related ESA. and why are wanting the details back dated to 25th Sept 2012

The letter is in regard the following

If your wife returns the ESA3 then she must include details of your pensions and savings, the assessment is in regard to your household income, savings and assets.


They are not trying to put your wife on ESA(IR), she may be entitled to an ESA(IR) top-up to her ESA(CB), although I think your pension and savings will prevent this.


You don't have to return the form but you must contact the DWP if you do not intend to.
