Hi I know someone in support group for esa and she gets disability premium as well . She had moved her partner in and he works full time . Is she still able to claim esa ? He works 40 hours a week

If their partner is working 24 or more hours a week then this prevents payment of any Income Related ESA which includes any Premiums they might be receiving, they need to contact the DWP office dealing with their claim immediately and there Local Authority if they are receiving Housing Benefit.

Thank you that’s what I thought .. I tried telling them they would be in trouble but she’s still claiming as partner still has a flat so she thinks it’s ok .

The rules on living with a partner can be very complicated, if the partner has their own address then they may still be considered as separate.
