Face to Face PIP report was created by Alison W.
Can you tell me if I’ve had the full msk test from this list?
(Notes in brackets are mine)
Able to
Tip head forward (dizzy)
Cross arms (across chest only, not shoulders)
Turn neck and body to look behind (no, only 20 degrees)
stand and balance on right foot and raise left foot off the floor
(He told me to use my quad stick, not mentioned in report. I couldn’t repeat with other foot)
put left hand and right hand behind head (only when I put my head down)
Turn a page over, gesticulate (no) use a stick (sometimes)
Not able to
Touch toes in a seated position - could only reach to knees
due to back stiffness and pain
reach hands below knees when standing
stand on tip toes
stand and balance on left foot and raise right foot off the ground
put left hand and right behind back only reaching as far as hips.
Great difficulty in getting up from seated to standing - four moves
to get to the front of settee (no, armchair) falling back uncontrollably
at first attempt.

There is no standard MSK test but you do seem to have been asked to do the majority of the activities that I would expect to see, the only obvious exception is a grip test, which you do not mention.

Is it legal to base the whole assessment on MSK and IO as above?
He either misquoted or didn’t refer to any of the evidence I sent.
Based on msk and io he decided
Eg
I could cook a meal with the help of my perching stool - I don’t have one, couldn’t use one
It’s not on the equipment list I provided.
Just need help in and out of bath ( no bath, OT organised walk in shower on equipment list))
if I struggle so badly to get out of a good armchair, how could I be helped out of a slippy
bath at ground level.
Social Services provide me with a full shower and all meals among other things.

IO said I was mildly tired,good concentration, memory, cognition
and didn’t need his help.
Could have been written about someone else. I struggled badly and he was very supportive. Eg He said he could see how things were but he had to ask the questions. And I have severe ME Fibro.
Based on msk, turning pages I had good upper limb function
using stick (to lean on to try and stand one legged!) Stick use is limited by upper body pain.

So have you had a Decision yet?
It's not illegal for the assessor's recommendation to be based on the MSK and their Informal Observations.
Did you explain why you cannot use a perching stool in your answer to Preparing Food?
Not having an aid will not help you score points.
Again, did you explain why you cannot get in and out of a standard bath in your reply to the Washing and Bathing question?
Dealing with the assessment report can be important but ultimately awards are made because the claimant has shown they meet the criteria for one.
