hello to everyone, i just have a few questions if anyone could help i would be grateful.
I've been sent a 'capability for work' questionnaire for renewal of my ESA. Last time i had to go to tribunal to get my ESA and recentley i have just won my PIP tribunal as well. the last 3 years have been extremely hard both financially and emotionally. i suffer from chronic anxiety and such situations affect my mental and physical health. i don't think i could go through that again. i have been lucky as i have had extra help both financially and emotionally from my siblings. however that will no longer be the case, one has gotten married and moved out and the other is about to. if my claim was refused or i had to go through the appeal process again i would struggle alot, it would greatly impact my mental health. i would like to explain my situation in the form. do you think that's wise? or would i be penalised?
I'm using your guide to fill in the form and believe i will stand a better chance. the evidence i have is from last year, the one i collected for my PIP. does that matter? i can't get new evidence in time. it will probably be the same anyway. i hope thats ok.

If your financial situation is contributing to your problems with completing the ESA activities then I would certainly explain why this is the case but if this is not the case or you cannot specifically identify how it impacts on you then it may be distracting from your other information to include it.
ESA awards are only made because the claimant has shown how they meet the criteria for one, so this should be the focus for completing the form.

thank you for that clarfication. could you also advise me on the evidence query. will the evidence from last year suffice? i could probably get a doctors letter again but that will just be a repetition of the previous letter. it will take me time to get the other letters from the other professionals i see. so i want to send the letters from them that i already have.

Sorry about that.
Yes, you can use the reports but check them first, if they were written for a PIP assessment then they may not address the ESA criteria, so you will have to "interpret" them for those looking at your claim. Whatever the content, integrate it into your answers on the form wherever you can.
