I am now in the position of being turned down for ESA I scored nil points but 4 days later I went to DLA tribunal and got High mobility rate and low rate of care. I was accompanied by a companion at both hearing and assessment he believe she didn't have her glasses on or the report applies to someone else I find the whole siutation distressing as I now have to appeal again for ESA. Any observation by anyone what to do on the appeal form to be completed?

I had an atos medical on wednesday. I was interviewed by a nurse for 1 hour who was ok, not friendly but not rude. She spent more time looking at her computer and my paperwork than at me.I have a very rare condition called Fabrys disease and recieve an intervenous infusion every 14 days for the rest of my life, by speialized nurse who comes to my home. I have key stage 1 kidney disease ,neuropathic pains , inability to sweat and many other problems linked to my disease. I told her about all 5 of my consultants, appointments and medication and things that could cause me more harm/ problems to my health and life. Really all she was bothered about was what type of house. I live in, who lives with me and can I open an envelope addressed to myself! :( i told her I was getting paid off on ill health retirement from my employer and also in receipt of DLA, she said 'ok' some how i dont think this mattered to her as long as she filled the spaces on the computer.
Its a waiting game now, not sure how long it will take beore I hear anything, hope its soon as i cant get it off my mind :S

Well done I to had a similar experience and had to go through to the Independent tribunal part of the complaints process. They agreed with me and I received an apology and a letter from the ATOS medical director saying that the medical report "was not medically correct or justifiable" unfortunately the DWP still would not reinstate my benefits and I still had to go to appeals tribunal (over and done in 2 minutes in my favor)

Word of warning though ask ATOS for a copy of all documents including emails relating to you and your complaint (They have to supply these under the data protection act) The reason I did this was that when I received the information it included emails in which I found out the doctor who carried out my medical had actually faced numerous complaints and had been disciplined before. I also identified that they use various levels of disciplinary procedures for their staff ranging from 1 to 4 each having different outcomes from just having a word with them about their behavior to retraining or dismissal. Further emails showed that the doctor had been disciplined before and due to my complaint he was going to have to face serious disciplinary procedures and therefore they where trying to manipulate the levels so he did not face the true / highest disciplinary procedures. The communication between staff and management trying to reduce his disciplinary was disgusting I forwarded this to the independent tier who again agreed that there was evidence of manipulating the disciplinary procedure. I later received a letter from the medical director indicating the doctor would face disciplinary proceedings and I would never have another medical with this doctor again.
