Dla review while appeal pending?

On behalf of a friend of mine , she has been on high rate mobility and high rate care for 4 years, she just had her claim renewed and was given low rate care only, a few things where missed out when filling in the forms.

she is now appealing the dession.

in the mean time i have been told its possible to have the current claim reviwed, this would be a good oppotunity at add the information that was missed out 1st time around.

my question is how will the results of the review be effected the the results of the appeal and vise versa? i assume if the i assume the effects of the review will take place from the date you submit the review froms? also how exactly do you get a review i have been told just to send in a fresh claim form and it will automaticly be treated as a review is this true?

If your friend is in the process of an appeal, her entitlement to DLA will be automatically reconsidered which is just another name for a review.

Any further (medical) evidence can be sent to the DLA Unit to be considered at the reconsideration or even the appeal stage, but it would have to be compelling new evidence to change their original decision. This would probably need to be further medical evidence, but evidence from any other source such as a carer, would also have to be taken into consideration.

If your friend has submitted her appeal within one month of the decision on her renewal claim, which is the normal requirement, there is no need to submit another claim. The reconsideration and appeal request will be effective from the date of the decision on the renewal claim.

If another claim is submitted within one month of the decision on the renewal claim, it is likely that it will be aligned with the appeal if the decision is not changed at the reconsideration stage.
