Incapacity Benefit was created by Rea
I am 53 year old female.I have been on IB for 5 years due to depression caused by bullying and harrassment at work. I am no longer working. I have been sent form ESA50. I was diagnosed with Cirrhosis of the liver (non-alcoholic) last year. I stopped taking Prozac when I was diagnosed with cirrhosis but I am still depressed (made worse by the diagnosis).

Should I go back to GP for a prescription for Prozac as I believe that unless you are on medication ATOS will not take the depression seriously.

Does Cirrhosis of the liver come under 'exceptional circumstances regulations' as there is no cure for it. I generally feel unwell and get tired very very quickly.

Please help.

You are right to assume that not taking medication will impact on the view taken by ATOS/DWP as to the seriousness of your illness, however, I would not want you to rush into taking medication simply to answer this question.

See your doctor, explain that you are going through the transfer and ask for his assistance in supporting you, if he feels that your depression needs treatment, then fine, but I would not worry too much about it if this is not his recommendation.

I am afraid liver disease is not counted as an exceptional circustances, but its impact on your ability to carry out the ESA tests, may have the same effect.

If you have not done so already, please have a look at our ESA guides in the Members area as they will explain how the process works and how to realate your illness to the tests.

If you have more questions please come back to the forums.

May I suggest that the British Liver Trust can offer support with information leaflets about liver disease.

In addition liver disease can be associated with cognitive problems and depression. So perhaps ask Doctor for opinion ?
