hi every one, does anyone know of any links to where i could find some evedince as to where letters do not get to the recipiants adress, posted from the DWP, i am in court for fraud, for not telling the DWP about any change of surcumstances, already had 7 opperations on my knee's and elbows, i have got a degenerative disease, because they have got me on survailance playing golf leasurly just to keep my jounts going (as my consultant has advised me to do) and i was high on pain killers and ibruphen, they think i have improved, i disagree imensley, i now need 3 knee replacements and 2 new elbow joints and only 50 years old tomorrow. i have never had a letter from them asking me of any change of curcumstances, they do not believe me, which is obvious. can anyone help.

Whilst we empathise with your medical conditions,I'm sorry that we are unable to provide information about undelivered letters. You could try contacting the Royal Mail.

Hi bobby,

You don't mention what benefit that you are in receipt of.

However, with all benefits it is usual to receive an awards letter annualy, giving a breakdown of the benefit that you receive.

Within this letter it generally states something similar to the following. :

"What should I do if my circumstances change?".

"If your circumstances change, it may affect the amount of benefit you get. You must tell us about any changes in your circumstances".

the benefit i was recieving, was DLA, if they do not believe me that i never recieved the anual letter asking that if there was any changes in curcumstances, it is their word against mine, if it is so important letter they should send it recorded delivery.

Hi bobbie,

I'm afraid that such letters have never been sent by recorded delivery, the cost alone would bar this.

As your case is a legal matter, I don't feel that I can offer any further advice.

It is up to your solicitor to put your argument across, and any mittigating cicumstances.

Whether you received the letters or not is irrelevant, you are still under a duty to inform the DWP of any change of condition, this could be improvement, (maybe less benefit) or worsening (maybe more benefit).

Has your DLA been stopped? You have also given us details of conditions that you have and you feel have got worse and is supported by your consultant?

I would suggest that you get conclusive evidence from a medical professional about your conditions and the help you need that arises from it. Medical conditions alone won't always qualify you for DLA, but its the help you need.
