Can anyone tell me what physical examinations happen at transfer IB to ESA medicals. Can I refuse eg to have my arms examined due to my neuropathic probelms and refuse to climb on to couch if this would cause me difficulty and pain? My medical is this wednesday and I am terrified, thanks

Hi B,

Have a look at page 46 3.1.4 of the WCA Handbook that can be accessed from this link. :

The physical exmination, if done, typically includes some basic tests to show the degree of movement in the legs and arms, it might be more specific to an area, if it has been identified on the ESA50 as one that would cause the claimant to pass one of the WCA tets. For example, the hands in the context of the Dexterity test.

You are entitled to refuse to perform a test at any time, if you do, and it is the case, then you should state that your refusal is because performing the test will cause you significant discomfort or exhaustion. This wording is important as it relates to the ESA legislation, make sure the ATOS "doctor" understands why you are refusing before they move onto the next test.

Hi B,

You could also look at page 61 onwards, Preparing for a medical, of the ESA claims on physical health grounds guide, from the same link.

I have been awarded ESA in the support group category thanks to the invaluable information available in this forum. No review date is mentioned in my award letter, is this usual? Previously my incapacity award had a review date.

Hi B,

Well done for gaining SG status.

To gain information as to your "prognosis", (your expected re-assessment date) you need to request your ESA85 medical report if you had a face to face assessment, or your ESA85A report, if you did not have a face to face assessment.

Either of these (ESA85 or ESA85A) should be requested in writing. (keep copy)

Your written request should be made to the Decision Maker, at the address on your ESA award letter.

cheers
