Hi about to help my friend post her esa50 form, she wants to send it recorded delivery, we are also sending a copy to the decision maker at local benefits office as well, what we are planning to put in with the decision maker;s parcel is a photocopy of the proof of psoting receipt, saying the questionnaire has been sent back on this date to this address. Getting a copy for her and sending recroded to the local decision maker as well, waht worries me is this, from what is placed on here, the royal mail are opening our post at the sorting office before the dwp receive it, surely this is against the data protection act, breach of confidentiality. Also, with recorded the dwp don't seem to sign for anything and have a marvellous record for losing things. Her form must be received back on 27/10/11. they will claim they have not received anything and it is taking 7 days to get to them for what is on this site. They send a first class envelope with the form. as many people are fretting they will receive this, with the hassle this questionnaire has put in it sounds like proof of posting is not good either. It seems they will use any excuse to say they have not received it to scare us further and stop benefits.

Hi,

We can only really say the same as fellow mod bro58 said in response to a posting on this thread:

www.benefitsandwork.co.uk/forum?func=view&catid=10&id=70882

''Hi, as Moderators we can only advise on relevant benefit queries.

We cannot give legal advice, however see information on Data Protection here. :

www.ico.gov.uk/

I should imagine, but can't be sure, that any company, including Royal Mail, who were contracted to open and sort mail for the DWP or ATOS would have to ensure that their employees complied with The Data Protection Act''.

But just to add, looking through the forum, we have had no complaints whatsoever about ESA50's not being accepted if posted in time. Therefore one can only presume there is not a problem provided the forms are returned in in good time. Even where in postings people have stated they have only posted them in a couple of days before the 'return by date' they have been accepted, so perhaps there is no issue to be concerned about time wise.

I am certain if claimants claim forms were being rejected for arriving at the DWP/ATOS late we would have heard about it.

Pete

The Royal Mail had a contract with the DWP to open the post and send it onto the local office.
It can take a few days before your claim shows up on the system as it is done manually,it does not mean it has not been recieved into the office.

when post is recieved by recorded delivery it is signed for as a bundle.

I used to work in the post room for the DWP before royal mail won the contract.
Hope this puts your mind at ease.

Pamela s, when you say that recorded delivery is signed for as a bundle did you mean it's signed for at the ATOS branch and therefore Royal Mail don't open it, or do Royal Mail still open that as well? I've also noticed that when I send my stuff to ATOS first class recorded it takes 2 days. thanks
