Good morning everyone, i would just like to tell you all that i attended crown court on the 19 oct 2011 for the accusation of fraud, (unexplained income)and was found not guilty, but now i have had a letter from the tribunerel service that i have got to attend, can they over rule the crown court, or will i get my mortgage payments and income support back dated.still got to go to the crown for my DLA, and probably have to go to another tribunerel.but i feel confident, so any body out there who has had a long wait, that is a good thing because it gives you more time to think about your situation and collate more supporting evidence, trust me the longer it goes on the better it is for you.

p.s.
renewd my membership as i think that this is a brill site, i keep looking just to see if i can help anyone with a little advice, as i have been going through my turmoil for the last 2 years

The important thing is that the Crown Court was applying a crminal test of liability, and the tribunal apply civil principles appropriate to benefit, concerning midrepresentation and failure to disclose. These are different tests, and so ensure you get advice and if possible representation. The Tribunal cannot overrule the crown court, they are different bodies one is crimnal, the other civil

Case involving suspected fraud investigations and prosecutions through the courts whether or not there is an acquittal as has appeared in your first hearing, involve complex legal matters and cannot be dealt with in an open forum.

In the first instance, I would be inclined to take this matter up with your solicitor who should be able to advise you about the questions raised in your post?

Hi there. Glad to hear you got equited, but surprised that It's taken so long to get sorted. May I ask what benefit you were on? Was It means tested then?

As for waiting a long time to get a Tribunal date and thus, hopefully sorted, is not a good thing. I live in pain every day, which cannot be changed, I have COPD as well as other ailments on top. Live on the third floor in a flat, no lifts, over 60 years old.But nothing can I do to make my life, as well as my older partner, until I have my Tribunal hearing.It will be a year next week since I started to get involved in all this.
