1 year Proposed Contribution based ESA

Good Morning

Can you advise me if the 1 year contribution based ESA proposal by the Govt is to go ahead.I have a Atos medical in a weeks time and am currently on Contribution based ESA and wouldnt be eligible for Income related ESA. Do I put myself through the stress of the medical knowing that my CESA would be ended as I have been on CESA for almost 2 years now?Also I am due to have major surgery within the next two months(have a pre-op appt at Hospital the day after the Atos medical)but there doesn't seem to be any provision made for this on the Atos medical form,even though the usual recovery from the op is 3months and I am still having physio due to previous surgery last Oct.

Hi W,

The Bill has not yet been passed.

Also even if your payments did cease, you would still need to consider whether to continue claiming it for the purposes of NI Credits with reference to your State Pension.

Unfortunately, even if someone claims ESA purely for NI Credits, they still have to go through the same ESA WCA process.

Hi SOI,

It is expected to be passed into law in April 2012.

However, at this stage we are not sure of the exact legislation.
