Hi, can anyone tell me where to send the SAR request to and for the attention of who?

Also where do I send my GL24 form and again for the attention of who?

I think it's the address on my original ESA decision letter, would that be right?

Hi J,

You can send both the GL24, and the SAR to the address on the original ESA letter that you mention.

Obviously, in seperate envelopes, and preferably by recorded delivery, keep copies.

On the SAR envelope it may help to write, SAR, Data Protection Request in the top left hand corner, and ESA Appeal in the same place on the other enevelope.

They should then be redirected to the approriate departments.

Thank you very much Bro, don't know what I'd do without you guy's :)

I have no one to represent me yet at appeal, should I write will confirm at a later date? Does it seem more likely to win at appeal if I were represented and would DWP and ATOS take more notice rather than me representing myself, if you know what I'm trying to say.

Hi J,

Try not to worry, if you can gain Representation, it may well improve your chances of success.

However, many members have been successful, without representation.

The Tribunal will make allowances, and most of the questions would be directed towards you, even if you had a Rep:

You can take some one with you for moral support if you wish.

Thank you Bro. I have got another G.P letter to back up why I feel reg 35 applies to me and was wondering if I should put it in with the GL24 or should I let them reconsider it on the evidence they had when the ESA50 form was sent and then maybe use the G.P letter at a later date if it goes on to appeal. I had a G.P letter and Consultants letter enclosed with the original ESA50 but although G.P stated it would be harmful to my health if I were not to have found to have limited capabilities for work related activity, I think more detail was needed as to why this was the case. All advice greatly appreciated Bro :)

Hi J,

If you want to stand a chance of having the ESA award changed at the automatic reconsideration stage, by the reviewing DM, who will be different to the one that made the original decision, it would be wise to send any new evidence along with your GL24, or as soon after as you can, as you may only have around a 4 week window for the reconsideration, once the GL24 is received by the DWP.

Quite a few of our members have had the award revised at reconsideration, therefore doing away with the need for the appeal to go forward to The Tribunals Service.
