Hi do I have to wait till I get an answer from the dwp to see if they have changed their dissection before I put in an appeal

Have you asked for a reconsideration of the decision?

Most people suggest that you put in an appeal request within the 4 week period of getting your decision and that way you will have your claim looked at again anyway before it may go forward to appeal.

Hi R,

A claimant has 1 month to appeal from the date of their ESA Award letter.

A claimant can either ask for a reconsideration only, in which case the claimant will then have to submit an appeal seperately if the decision is not changed at that stage.

Or, they can submit an appeal straight away, where an automatic reconsideration will take place as part of the appeal process, if the decision is not changed then, the appeal is sent forward to The Tribunals Appeals Service, without the claimant having to take any further action.

So the first scenario above needs two seperate actions by the claimant, whereas the second only needs one action, i.e. submitting an appeal.

Hi Regal

If you have asked the DWP to 'look at the decision again', otherwise known as a review/reconsideration, you will have one month from the date of their new decision to appeal. Otherwise we recommend appealing straight away.

The DWP will automatically reconsider their decision prior to appeal and your case will automatically pass to appeal if the decision is not revised.
