ESA50 and information was created by sally-jane
Hi,
I am trying to explain my ESA migration to someone but admit have not understood how to explain it properly, please help.
Here goes, please fill in the gaps.

IB=14 years, filled out ESA form Nov 2011,received info on to ESA WRAG in Jan 2012.Sent of info for appeal Feb 2012. Received basic letter March 2012 to be placed in Support Group.
Have not sent in any other paperwork or completed my collection of GP notes,Consultant reports, etc etc evaluation for an appeal.
I understand it that then someone just took another look at my original form and accompanying stuff and thought 'WRAG a mistake we will put in Support Group without any need for a medical or any further papers to look at.'
Have I got that right and is that the normal state of affairs within the time span I have mentioned.

Hence it did not make it to appeal and is therefore a re consideration of facts received.

Hi PCM,

When a claimant appeals a decision, in your case an award of WRAG ESA, an automatic reconsideration will take place by a different Decision Maker.

At this stage the ESA award can indeed be changed purely by the DM looking again at the original evidence.

This seems to be what has happened in your case.

Therefore there would be no need for the DWP to forward your appeal to the Appeals Tribunal Service.

Here is a guide to how the system is normally supposed to work:

hiya,
many thanks for making it more succinct.
So it appears I had a lucky break and a DM with a bit of sense.
thanks

Well I am still waiting to get the written confirmation that I am in the Support Group. My carer rang them this lunchtime and was told 'no idea why your letter has not been sent or the additional info you asked for'.She said she would put in a request for all of it to be sent to me. I know I am only in the Support group for 6 months, backdated to December 13th 2011, therefore I shall no doubt be getting a new ESA 50 form to fill out again b4 I receive the confirmation from the last round by a DM.Thats how it goes I suppose. My GP is not amused that they will have to redo letters every 6 months, I can see a refusal by the surgery before long.

I read somewhere that although we have to ensure all our paperwork is indeed sent to ATOS/DWP and that we are able to prove we have sent it to them, they themselves do not have to prove it, moreover half the time they are not sure if/when and what they should send to us the claimants. Is this not a rather one sided set up. Beause if we forget to send in something we should have done, we get penalised, so why is it not also the other way too.
