Struggling to get re-assessed was created by Kirky63
After reading posts on here and finding them very informative. My husband rang regarding a supersession. He was told that DWP would send him a new form to complete. That was on the 17/04/2012 nothing arrived by 25/04/2012 so we sent a letter requesting the same form. Still nothing has arrived. Where do we go from here has anyone got any suggestions how long it will take before we receive the ESA50 please.

We're in uncharted territory to some extent with ESA claimants requesting Supersessions as their ESA(CB) comes to an end :)

I know how stressed everbody is over this situation, but I think you are being a bit optimistic to expect a new form to be issued within a week. The DWP have to receive and process the request, then they need to pass your file to ATOS, who actually issue the form, even if the DWP and ATOS were working normally, I would have thought four weeks was more likely, and the liklihood is that it is going to be longer.

I am so angry :angry: Have today rung up to chase the ESA50 that I requested a month ago for my husband to get re-assessed, only to be told that he has to appeal. I said how can he appeal something that was decided two years ago, they said that it would be a late appeal.
I explained that I think the information was incorrect, they said that they would get someone from the benefits department to ring back to advise this afternoon. That has not happened
Their records show that the form was requested but then the record has been closed down without any further action and the document not received.
Apart from having heart disease Ray suffers from depression, imagine how this is effecting him. He is 64 this year and got to wait another 19 months for his state pension without any money of his own its disgraceful!!!
Where do we go to from here, hoping you can advise, his condition has worsened considerably in the two years since his last medical. No one has ever asked him to attend any work related interviews so they obviously except that he is not well. :(

You are correct that a two year old Decision cannot be appealed, the maximum period is 13 months, and whilst the DWP do have some latitude to accept late appeals, the Tribunal Service will certainly not accept one of this age.

The level of knowledge shown by the call centre staff, has always been variable, but there does seem to have been a significant decline over the last few months, with their knowledge of even basic benefit processes beng absent.

Usually a call back is done by someone with more experience so hopefully they will be able to sort you out.
