wrag group apeal

Hi I have been placed in the wrag group I was not happy about this as I feel that I should of been placed in the support group so I have appealed, I asked for a statement of reason for which I received fairly quickly I’m a bit confused about what was on this it firstly they have sent me a ESA medical report is this the same as a “SOR”.
On this report it sates ADVICE FROM THE APPROVED DISABILITY ANALYST –which the person states I AM ABLE TO ADVISE THAT THE CLAIMED LEVEL OF DISABILTY IS CONSITANT WITH THE EVIDENCE BEFORE ME.

Then it states PROGNOSIS – I ADVISE THAT A RETURN TO WORK IS UNLIKLEY IN THE LONG TERM

Then in the justification of advice it basically rubbishes the things that I have put down on the esa –which i find strange after they wrote form states I AM ABLE TO ADVISE THAT THE CLAIMED LEVEL OF DISABILTY IS CONSITANT WITH THE EVIDENCE BEFORE ME.
then finishes off with the statement with this sentence – THE ESA50 AND MED 3 INDICATES THAT THE CLIENT IS UNLIKLY TO RETURN TO WORK IN THE LONG TERM

I recently had a wfi and the lady agrees with me it seems odd with what this letter says but was unable to comment further –what do you think do you think this form is contradictive and that I should be placed on the support group any advice would be appreciated thanks for all the previous support and advice

No, the ESA85, medical report, is not the same as the SOR. Many people, myself included, have had difficultly getting hold of the SOR recently.

I know that one of our members had a successful claim based on the fact that she should be in the Support Group if it was agreed that a return to work would be unlikely in the long term - I think that Gordon might be able to give you more advice about this.
