Ive searched the forums and as theres so much info here i cant find what Im looking for really.
My claim for DLA was first applied for Feb. 2011, Ive appealed and it went before the 1st tier tribunal, Ive just received the Statement of Reasons but dont really know what to do next.
Trouble is there are a lot or reasons that are not exactly true, there word against mine! What can I do next, I only have a month to do something and now its getting desperate.

Anyone with any info would be good, thanks.

If the 1st tier tribunal found against you, I'm afraid you can only take your case to the Upper Tribunal on a point of law, not because you don't agree with the decision.

This is a complicated matter as it requires an understanding of the law in the first case. You will need to get advice from somewhere like CAB.

Thanks Mrs H, great name, love it.

I thought thats what would happen as I know it would be the law Im challenging.

Because its gone on so long, my condition/health has deteriorated immensely and the tribunal has arrived at their decision based on what my abilities were.

Would making a new claim in a few months be an idea so info was more up to date?

As you have indicated that your health condition has deteriorated, it is advisable to make a new DLA claim immediately.

It was correct for the tribunal to deal with the situation as it was when the original decision was made. You are certainly entitled to put in a new claim.
