Income Related and Contribution Based ESA

I have received aletter from JCplus which refers to both IR and CB ESA and I am totally confused as to whether I am going to receive any money then or not although it was stopped at the end of April(365 days)at the end of the letter it states that I am entitled to CB ESA and they will pay me £94.25pw but as yet nothing despite numerous phone calls to JC+. I attended a Tribunal in Jan 2012 and won and was placed in the SG but then in early April I received a letter from the Courts saying I had been transferred to WRAG with no explanation I saw my JC+ advisor 11th June for the first time in 18 months who in no unceirtain terms told me I was getting NIL what a pleasant visit my wife is a pensioner and we only have two small pesions Any thoughts or ideas what I should do I'm getting fed up with trying to reason with these people from DWP

To be honest, with so many queries on your claim, the best advice I can give is for you to get face to face advice, see

Where to get advice?

You may be eligible for Income Related ESA but you pensions will be counted as income and therefore may not qualify.

You need to find out why you were moved back to the WRAG, which will require you to contact the Tribunal Service. Until you understand this, you cannot make a decision on how to progress your existing ESA(CB) claim, if indeed you can.

I have actually written to the Tribunal Services on 29th May but have not received a reply yet if I get moved back to SG will I receive payments.

Hi,

It really is impossible to say. if it is income related ESA then your pensions and wife's pension/income and any savings etc may negate any payment award. Without knowing all your incomes etc it is impossible to even guess hence your need to obtain face to face advice as Gordon mentions above.

Mod Edit - Gordon is correct above if it is Contributory ESA you are claiming, however the above would be the case if Income Related.
