I was originally awarded ESA WRAG after completing the questionaire for the WCA. I never had a medical. I decided not to appeal the decision and simply see what would happen. As it happened I have just put myself through 3 months of pure hell and my health has suffered because of it.

I attended a work focused interview and although the person I saw was sympathetic she said I should attend a 'voluntary' session with a work programme provider Seetec. I was assured it was only a voluntary initial session.

But when I attended the session I was told by Seetec that it was mandatory! I was upset as you can imagine and contested it. I also refused to give consent for them to use my personal data. I wrote them a letter explaining my health problems and withdrew any such consent to use my personal data. At the second session I ended up having their case worker contact JCP to confirm I was voluntary. I also contacted JCP and got them to send a cancellation letter WP11 to Seetec confirming I did not have to attend anymore.

In the meantime I had sent off a letter and subject access request to the DWP explaining the situation.

I have just received a letter from them stating I have been reassessed and moved to the support group!

Of course this is great news on one hand but my main concern is they may try and slip me back into a WCA right away and I may have to attend a medical? If that happens I could end up worse off depending on the outcome.

Do you think they will make me attend a medical?

Unfortunately, there really is no way to predict whether you would need to attend a medical or not.

The fact that you were placed in the WRAG without a medical and them moved to the Support Group as a result ofyour written statement, is quite positive, however, a different ATOS "doctor" at your next assessment may decide otherwise.

All you can do is present the best case in a future ESA50 and any evidence you attach to it. One thing you might consider, is what was it in your letter that resulted in your being placed in the Support Group, that was missing from your original ESA50.
