365 day limit was created by petrocelli
i won't be entitled to ESA after 365 days, have paid into NI Conts for 38 yrs.

if my appeal's still in the queue after 365 days, if i'm succussfull is it backdated? been told could be waiting 12-14months............handy for gov't to make us wait past 12months eh!

At the end of the 365 days, your payments will cease.

If the Tribunal places you in the Support Group, your payments will be re-instated and you will receive back payments to the date of the Decision you appealed.

If you are placed in the WRAG, then you will not receive any payments but will receive NI Credits towards a full State Pension.
