Hi all
I will try to keep this as short as poss.
Over the past 13 months i have been given the runaround by Jobcentreplus and i am now at my wits end with worry after hearing news today.
1) I returned my ESA50 to be transferred from IB to ESA in May2011.
2) June 3rd i received letter to say i was in WRAG(no medical)
3) July 2011 wrote to JCP to tell them of new diagnosis
4) Over the next 6 months i called JCP with various concerns,and told information woild be passed on
5) In May 2012 i rang to ask JCP when my reassessment would be as it stated on form it would be on 25th May 2012.I was told to expect it shortly.
6)In early June i contacted my MP to ask if she could help and also told her that over a year later i had never been called to a WFI, yet on 7th Aug my benefit would stop due to 365day rule
7) My MP contacts me to say there was a major error and that i was not showing on the system and she was writing for an explanation.
8) a few days later i received a new ESA50 which i have just returned, after contacting a welfare charity who agreed to help.
9) Because of the shambles the charity applied for a late appeal at the end of june 2012.
10) 2 weeks ago i received a call from a director of JCP south england to apologise for errors and to say my appeal was accepted and that i would continue to be paid until appeal heard
11) On sat i received letter to say DM had reveiwed my file and kept award same and were sending my papers off to tribunal.
12) today went to first WFI very nice man explained as i was what they call old stock(on IB since 1995) i was not required to do mandatory work programme, the noted my benefit stops on 7/8/12, told him what director had said about benefit carrying on until appeal, advisor said get it in writing.
Came home rang director who after ringing someone else called back to say he made a mistake, money would stop.
I have never received the letter u should get 8 weeks prior to stopping money, find the whole saga a fiasco
Sorry so long will not do so again.

As you you already have an advisor we're not in a position to comment on your appeal.

With regard the 365 day rule. The DWP have said that will give 8 weeks notice of a claimants payments stopping, but as far as I am aware they are not obliged to do so in law. You can certainly make a complaint regarding their failing to contact you regarding this.

Complaining to the DWP

As you have found, there is no relaxation of the 365 day rule, even when appealing, however, if you meet the associated means test, you could be transferred to Income Related ESA, in which case payments would continue.

Also if you are placed in the Support Group as a result of your latest ESA50, your payments will continue.

In either case, your appeal can continue in parallel.

Thanks Gordon And Jim
I was not really expecting any advise as you say i do have a welfare charity already helping.
I just thought people should know the mistakes being made even by people at the top end of JCP.
I have contacted my MP and requested that she gets someone to make a proper investigation as to what has gone wrong so that others dont suffer the same fate, and also told her i want her to seek financial redress for maladministrtion,as there were a number of other errors made that i did not have time to mention.
