ESA Incontinence was created by megan
Hi, I have recently moved from IB to ESA and scored 21 pts in my medical, 15 points for incontinence of bowels. In my medical papers the ATOS nurse also stated my problems occur weekly and are significant. I have however been placed in WRAG not support group. Could I appeal with a written statement, I really don't want to attend an appeal. I do think however that I passed everything I needed to to get in the support group.

You can request a Paper hearing, that you do not need to attend, however, you need to be aware that the success rate for this is lower than for an Oral hearing, which you do attend.

It would be worth you requesting a Statement of Reasons from the DWP Decision Maker, as from your post they appear to have overridden the advice from the ATOS "doctor" regarding your weekly incontinence problems.

Please have a look at the following FAQs

Is there any risk to challenging a decision?

How long do I have to appeal?

How to submit an appeal

Qualifying for the Support Group

12 Month Limit for ESA(CB)

Do I have to attend WFIs while I appeal?

The Support Group descriptor needs you to be significantly incontinent at least once a week, so it does sound as if you should have qualified. You can ask for a written hearing - although these are statistically less likely to be successful than oral hearings. If you can provide compelling evidence ou might get the decision overturned at reconsideration. However, don't forget that it is possible to lose everything - it sounds unlikely in your case, but you do need to be warned
