Before I ask my question I would just like to thank mrs Hurtyback and Gordon for your last replies and advise.
I have now been asked to go for a medical assessment on 16th October after waiting 5 months from my ESA50 been sent back, I could not get a support letter from my GP as I had just moved and they only had a few digital notes, as you can imagaine I'm scared witless and the fear of losing is frightening. Would it be possible if I could ask my Gp if I could have a medical report or is a bit too late.

You have nothing to lose, you can take a copy with you to the assessment if it is ready in time, if you do this then I would recommend that you also send a copy to the DWP.

If it is not ready for the assessment, then send a copy to the DWP as soon as possible, they should accept evidence until a Decision is made, mark it for the attention of the Decision Maker.

You waited a full 5 MONTHS before hearing anything about your ESA 50 form ?

I'm starting to go stair crazy after just 6 weeks !

Gordon,
Many thanks for your reply, I went to my doctors yesturday he did the medical report there and then just ran all my active problems and medication, he told me that I actually should qualify for the support group as I suffer with oesophagal stenosis (stricture), as I have had half of it removed, and I cannot swallow food properly and I get sick trying, it can take up to an hour to eat a simple meal. What I am asking is If I sent this report to the DWP could I ask if they could take this into consideration? as I noted it on the list of conditions for the support group. Many thanks

yes it drove me mad apparently my assessment date should have been October and they sent me the form in March, I only found out in August, hope things go ok for you.

Yes, you can.

I would get some copies of the report, send one immediately to the DWP office dealing with your claim, marked for the attention of the Decision Maker, I would enclose a covering letter explaining what the report is and referring the DM to the Chewing or Swallowing Food or Drink Descriptor, you will also need to refer to one or more of the sub-descriptors as appropriate.

Take a copy with you to your ESA assessment and give it to the ATOS" Doctor" to read and ask them to include it in the file they will return to the DWP. They are required to read the letter under section 3.1.2 of the WCA Handbook. You may need to answer questions on the contents of the report, so be prepared to do so.
