i thought i would share with you my situation and see what others think i should do - i have fibromyalgia - had it at least 10 years and have been diagnosed by a specialist - I used to work for the civil service and got medically retire at 38 by a CAPITA doctor who specialises in people in the work place 5 years ago as i had had the fibro for over 5 years and they felt i would not get better - I have arthritis in my hands and have both hips replaced as well as the fibro - i have been on ICB for 10 years and now have a small pension but i expect you have guessed that they are now saying i am fit for work - i suffer terribly with the fibro and am in bed days at a time with it - i have appealed and that has been turned down and it came yesterday after 6 months i have been turned down again so my only option is to go to tribunal - is it worth all the stress and upset as i am agrophobic and get panic attacks too - i cannot survive on my small pention so what other options do i have - any help or advice would be greatfully appreciated ,

Success rate for a Tribunal hearing remain at about 40% and we regularly hear of claimants going from 0 points to 24 at a hearing.

If you have been found Fit for Work your options are to find work, claim JSA and look for work, or to pursue your appeal, so if you feel unable to perfrom either of the former options, then you have nothing to lose by appealing.

The statistics I quoted above, are for Oral hearings where the claimant attends, the statistics for a Paper hearing, where they don't, are a lot lower, You can increase your chances of success by getting representation, the CAB quotes a success rate of 76% where they are involved, however, it is becoming increasingly difficult to get assistance and they may not help as you are already in the appeal process.

It is worth noting the a Tribunal will re-evaluate all of the evidence and anything new that you supply, so it may help if you go through or ESA Claim guides, to see if you can present your case better.
