Does Industrial Injury Benefit affect ESA

Hi, my brother has just been assessed for Industrial Injury Benefit after having an accident at work.His partner is disabled and is getting DLA and ESA.My question is will his I.I.B. affect her E.S.A.

If your brother's partner is on contributary ESA then his IIB will not make any difference (this bit I am sure of). If she is on income-relted ESA, I would expect his IIB to be counted as income and reduce the amount of ESA (or even put them over the limit for claiming).

I'm sure one of the other mods will tell us if I am wrong!

Hi n666,

If the ESA is Contribution Based only, as this is non means tested it should not have any effect.

However, if the ESA is Income Related, or her Contribution Based ESA has an Income Related ESA top-up, it will be classed as income, and she should inform the DWP.

If she has any doubts, it would be best to inform the office that deals with her ESA, anyway.

Her DLA will not be affected.

Industrial injuries benefit should not affect her DLA, as this is not means tested.

It will not effect her ESA unless she is getting income realted ESA, as this will count towards the "household Income"

IIB, is paid tax free like DLA.

By the way they both need to be careful as to what is stated in each of their forms.

Eg, if in her ESA and DLA claim she has stated that he is her carer and does all the lifting and carrying, and in his form for IIB he has stated that he cannot lift or carry, this can lead to serious consequances for both.
