re back dated benefits. DLA/Income support

Hi all,
With the help of this site i recently won my DLA appeal from low to middle rate care and high mobility. i recently recieved my backdated pay from the DLA but am wondering about my other benefits i.e. severe disability payment and income support. i phoned the DWP today and they say my income support was stopped due to going on low rate care (this i knew). some one is phoning me tomorrow to let me know if the old claim will be reinstated or if I have to make a new claim. My question is am i entitled to claim this money back like my DLA and if I have to make a new claim will this initiate the migration to ESA.

Hi T,

As the Tribunal decision is a remaking of the original adverse decision that you have appealled successfully, you will be treated as having been awarded Middle Rate Care Component since that time. Hence the backpayment of DLA. Therefore, if your income, assets/savings have not altered in the time since the adverse decision, you should therefore be entitled to the Disabilty Premium from that time also, (As you were entitled to and receiving it prior to the adverse DLA decision).

With respect to your other query, this should not be a trigger for your migration to ESA.

i feel more confident to speak to them tomorrow now. My income and assets have not increased during this time. So hopefully I will get it all backdated without having to re-apply.

They may still require proof of this, and request finacial information to that effect.
