Hi Everyone

We had our xmas rained upon,after my poor husbands transfer from ib to esa was declined. My hubby suffers from amxiety and depression. It is a shame that I didn't find this site until after the form and consequent medical assessment were done. We do intend to appeal and my hubby is due to see our Doctor who says he will lend his support. I am currently trying to read everything on this site, They didn't even allocate him a single point. My hubby is a really poor communicator who won't even answer the phone, walks everywhere, unless I am there, when he will drive (badly and aggressively,as he finds it stressful) but I work full time so this isn't often, he doesn't catch the bus , as he hates being stuck in close proximity to people he doesn't know, this makes him break out in a cold sweat...and on and on,

Can anyone offer the benefit if their experience, especially if there is a Mental Health problem.

Hi kit,

I am sorry to hear about your husbands outcome with his transfer. I had exactly the same experience back in october although i scored 12 poiints. I got straight in touch with my gp and local mp. My doctor supplied a full mental health history which he kindly emailed to me. I then forwarded this and my own detailed account of every way my mental health affected me daily from the moment my eyes opened and if i was lucky and they closed at night !

My local mp was very sympathetic. He told me they deal with one person and get them sorted quickly !

My advice to you would to do what i have done. The appeals process can take months and months . With your Mps intervention you may get your appeal fast tracked and sorted for you.

Hi CC,

I am sorry to hear that your hubby failed the ESA WCA. :(

If your hubby is going to appeal the fit for work decision, he must do so within one month of the date of the decision notice letter, using form GL24, which can be downloaded and printed off from the link on this page : How to submit an appeal

Once you have submitted the GL24, you will also need to obtain a Med 3 "fit note" from your G.P. to cover hubby from the date that his IB ceased, submit this also, keeping copies of both, see :

Sending Documents to the DWP or ATOS

Your hubby should then be entitled to Assessment Rate ESA whilst the appeals process progresses. This process first involves an automatic reconsideration carried out by a different DWP Decision Maker, if the decision is not changed in your favour then, it will automatically be sent forward to The Appeals Tribunal Service.

The important issue Re : the appeal is to show how your hubby qualifies under the the descriptors, in either :

Qualifying for the WRAG

Or :

Qualifying for the Support Group

You may also wish to request a copy of the ESA85 Medical Report that would have been generated at your hubby's face to face assessment, you can request this over the phone, but we advise that you back this up in writing, see :
