Hi
I have recieved my renewal remminder from motability that I need to order my new car soon, which i have already chosen the vehicle I want which carries a sizable deposit, I have had my award for approx 9 yrs now Indefinite, with this remminder from motability they also included as follows: major changes to DLA, which I knew about, it states sometime between Aug 2013 & Spring 2016 claimants will be assessed and if you are not awarded the enhanced rate you will have your motability car took back, and even if you appeal you will still have the car took back, if you win your appeal you will be allowed to join the scheme again!! this is a bit worrying if like I understand DWP employ ATOS who have made a right mess in assessing people with ESA are they going to make the same mess up with PIP?? I won my appeal with ESA and was put in the SG. (RIGHTLY SO) in my recconing a lot of genuine disabled people will lose there cars? when claiments recieve the questionner form for PIP will the DWP let you send Medical notes in of evidence of your conditions or not? will they write to your GP etc?? if someone would be able to help me with my questions above and possibly other genuine disabled people I would be very grateful indeed :side: Thank you

I am afraid that Motability changed it's operational procedures some time ago, anyone who loses their DLA Higher Rate Mobility on renewal or re-assessment, will lose their Mobility car within weeks of the change, even if they appeal.

When I got my first Motability car (a long time ago!) the rules were rather different. Amongst other things if you had to surrender your car your had lost the advance payment in its entirety. However, the latest version of "Lifestyle" (the official Motability magazine) has a information box on "Stopped allowances", which says (amongst other things)

If your mobility allowance stops and the car is returned, you do not have to pay for the remaining length of the lease. If you paid on Advance Payment, this will be refunded to you on a pro rata basis within a month of your car being returned.

The partial return of the advance payment is, I think, relatively new and it sounds as though that might be a factor in your decision.

I think that this new policy was probably introduced in reaction to much more draconian rules on returning cars e.g. not letting you keep them until an appeal has been heard. We can't be sure that this policy will carry over to PIP or will be retained, but I would be hopeful about this policy on APs staying in place, especially for leases taken out under DLA rules.

You might also remember that the "migration" of DLA claimants with indefinite awards will not start this year, except for those caught up in the trials. This means that you might easily get a year's usage out of the car, even if you don't get PIP at the higher level immediately. The risk of losing your award in other ways remains the same.
