Bit tough though if you just fail the means test and through no fault of your own one of you cannot work due to sickness or disability!

You become statistically anonymous, the estimate is that 400,000 who have lost their ESA(CB) and are not eligible for ESA(IR).

I suppose what may seem unfair is that if you can get into the SG of CB ESA and have a partner bringing home £100K a year but nothing in the SG of IR ESA if your partner brings home just over the means test or works slightly over the hours!
