point score sheet for ESA and ESA85A

HI there, i have just received my appeal papers and have a few questions

1) it states in the scheduled of documents list, the decision makers score sheet.

but i cannot see one..there is a ESA85A AND A LT54, but nothing that looks like a score sheet.
what does it look like?

I also did a SARS request and cannot see anything looking like point score sheet in there either.

2). there are also several inconsistancies about a medical .
it says in the appeal papers section 4: the facts of the case that i attended for a medical examination- however that is incorrect.. I have never been seen by anyone.
And there are two medical reports included.. a IB85A and a ESA85A .. which relate to using ESA50 questionarries.

3) there is no indication that they have contacted my GP for advice.. no reference to a
ESA 113 in the appeal papers or in the SAR's documents i received...and they have stated in the appeal documents that I have "not stated which descriptors she thinks appyly , but has listed her conditions".. however in my covering letter for appeal i clearly state my reasons for appeal ( i used the same wording as the descriptors) because i mean 2 descriptors for limited capability for work related activity. ( walking distance and bowel/urinary incont)
So it would appear that they have not taken my information as evidence nor have they sought any confimation from my GP....Not sure how to present this at an appeal.

4)Also one of the ESA58 forms there is an error with my conditions...it makes no reference to one of my diagnosed health conditions at all and incorrectly the health care professional says i have CFS.. and i do not.. i have MS and have presented some of difficulties i have with MS fatigue , but CFS is not the same condition.

Should i tackle these above points within a submission?

Hi n,

1) As it seems that you were assessed on paper scrutiny alone, (no F2F assessment) as an ESA85A was generated.

It is highly unlikely that a score sheet was generated, it should give information in The ESA85A as to how you were assessed as having LCW (Limited Capability for Work) (WRAG).

The "prognosis" (recommended) length of award) should also be included.

2) Any discrepancies in the documentation can be brought to the attention of The DWP DM, if you wish to challenge the validity and quality of The Medical Report (ESA85A) itself, you can do this as a separate issue by complaining to ATOS :

Even though discrediting the ESA85A, may help your cause, that in itself will not gain you entry to The SG, that can only be done by proving that you fulfill at least one of The SG Descriptors.

3)

The DWP/ATOS do not have to issue an ESA113 to your G.P., in fact in the majority of cases they don't.

You could ask your G.P. whether they have received an ESA113, to confirm whether one would have been present, however, if an ESA113 has be used in evidence, it is generally cited in The ESA85A.

4) See my response at 2) regarding quality of ESA85A.

You should reiterate how and why you fulfill at least one of the SG Descriptors, as previously stated, it may help to discredit The ESA85A, but this alone will not gain you entry to The SG.
