hi can anyone help me, i recieved a dla80 form 10 october 2013, i filled it in and sent it recorded delivery, in feb 8th i recieved a letter telling me to attend a medical on 4th march, but on the week before i was due to go i recieved a letter from dwp telling me i was on the correct rate indefinatly, i contacted my dr and got a copy of the evidence he had sent and the dwp had obviously accepted. i telephoned dla people in blackpool only to be told, file the letter away and forget it and still attend the medical, which i did, i am now awaiting their decision again. could someone tell me if this is legal as i am so worried.

It is obviously unusual for this to happen, but I could not state that it was illegal, whilst the letter you received is indicative that a Decision was made on your claim, it may have been produced in error, I would suggest you wait until you receive (another) Decision notice before considering any actions you may want to take, as it could easily still go in your favour.

However, if this is not the case then in addition to requestiong the documents used in the Decision, you might want to create a SAR specifically in relation to this letter and the matters surrounding it.

thank you gordon, what worries me is fact i had to attend an appeal in 2001 which went in my favour and i recieved a letter from sec of state office stateing because of my disability i could not cook or prepare any meals it was law and such laws were quoted on the letter but i dont know, can they just change the laws like that?. i also cant dress myself because of spondylosis caused by an industrial accident in whih my back was broken. the examining dr was polish and just kept saying you must realise i dont make the descision. but im sure they must give an opinion.

Even DLA claimants with an indefinite award can be re-assessed under the Right Payment Programme, see

Also, if you are not already aware, all DLA claimants between the age of 16 and 65 will be re-assessed for PIP, which begins replacing DLA from the end of this year. See
