Hi Mods,
I require a bit of advise please, my neice who was going to represent me at tribunal can no longer do it as she is a solicitor and her firm won't let her unless i go through her company, she was going to do it as my neice not as a solicitor but my understanding was that being a solictor made no difference something called A Mckenzie's Friend i think Jim mentioned it a while ago ,so now i don't know what to do , she has received some paperwork today i have not received anything, so is my tribunal hearing imminent ? i have,nt even had a letter about a reconsideration. I sent my GL24 on the 17th July 2012

I think it unlikely that your hearing is imminent, most hearing are taking about six months to be heard from when the DWP pass your papers to the Tribunal Service, if their Reconsideration fails to change the original Decision.

You might want to check with your daughter as to papers she has received as they are likely to be in connection with your appeal.

You may be able to find somone esle to represent you, but I have to warn you that most Welfare Advice agencies will not take on a case once it already been appealed, try doing an internet search for "welfare advice" with your town or county.

Many members have successfully represented themselves, so even if you cannot find anybody, all is not lost, you might want to have at the following for a better idea of what is involved.

Thanks Gordon,

The papers my neice has received are copies of the ones that told me i had failed the assessment and also a letter stating that they believe she is representing me at tribunal and that there would be a letter to follow for her to sign to that effect

You need to find out who the letter is from, if it is the DWP then it would suggest that you are still in the Reconsideration phase, although I have to say that 8 months is a very long time for you to wait for this to be done.

If it from the Tribunal Service, then your Reconsideration has failed, and the DWP have passed your papers to the TS for a hearing to be convened.

In either case, you need to make sure that all future correspondance is sent to you, unless you are to find a new representative.

Thanks Gordon i will check with my niece, but i think the papers are from DWP and i have not had any letter to say if ive had a reconsideration which surely i should have done by now.

Unfortunately, for many claimants the first time that they know that their Reconsideration has failed, is when they receive their evidence packet from the Tribunal Service.
