FORM LT54 ADVICE NEEDED

FORM LT54 ADVICE NEEDED was created by Elaine
Recently migrated from Incapacity Benefit (12 years) to ESA and was placed in the WRAG group. I then contacted the DWP and lodged my appeal. Following advice on this site, I also made a Subject Access Request for all the associated paperwork which I received last week. Alongside the original ATOS decision (made by a nurse) was another form, LT54 (DMARC) with a later date.

The LT54 form stated:

"Having considered the available evidence, I have determined that by reason of her (physical and/or mental) condition at least one of the descriptors set out in Schedule 3 to the ESA regulations apply. She has limited capacity for work- related activity and will be placed in the Support Group. / She is treated as having limited capability for work-related activity"
(Decision Maker (*.******. dated 01/03/2013))


However, I have yet to receive any formal confirmation of this decision from the DWP.

Two weeks ago I received a letter from Job Centre Plus invited me to my first work-focused i(WRAG) interview this Thursday. I send them a reply last week enclosing the LT54 form, fully expected that meeting to be cancelled. However, I have just received a reply from Job Centre Plus, stating that I am still in the WRAG group and still compelled to attend this meeting?

I would appreciate any advice people can offer on how best to proceed?

Hi E,

The LT54 does seem to indicate that you have been placed into The SG by The DM, as Schedule 3 is the SG (LCWRA) descriptors:

Is the date of the LT54 after you submitted your appeal ?

You need to contact the DWP, and gain clarification of this issue.

You may also wish to contact the JCP Adviser, and at least ask them to defer your first WFI, (or carry it out over the phone) until this is sorted out.
