i have updated my thread; ESA Appeal- Confused again! with what iv been told today, im sure the info will help you.

when you appeal ur award is automatically looked at again by a new decision maker. if they do not change the award, they forward your appeal onto the tribunal board & send you a copy of all your documents. you then have time to submit any additional info to the tribunal board. you could also withdraw your appeal at any time.

What is the difference between an appeal and a reconsideration, if any, hope i am not sounding really silly, but i just need to know if there is i big difference!!!!

I will still be writing to them first thing in morning and posting recorded special delivery.

Hi R,

If a claimant requests a reconsideration, another DM will review your case, and decide whether or not to change the decision.

Once you receive written confirmation of this reviewed decision, if there is no change you will have a month to make an appeal to the DWP, and this will be sent forward to the Tribunals Service, where your appeal would be heard at a Tribunal, at some time in the future. (it is taking up to 12 months at the moment).

If you appeal, then a reconsideration takes place automatically, if the decision is not changed at reconsideration, then the appeal is automaically sent forward to the Tribunals appeal process.

So if you appeal, it saves requesting a reconsideration initially, and then submitting an appeal if the adverse decision is not changed.

Either a reconsideration or appeal request must be made on a GL24 form, (Download link is provided on the link that I have provided for you previously)within a month of the date on your WRAG award letter.

When a reconsideration is requested, can more info be sent to new DM??

This was not made clear, as the person i spoke to kept leaving me on ho;d to speak to someone else, who now comming to think about it may have been the original decision maker.

As i would like to send in more info.
