The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.
Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;
"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"
than their opinions
"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

thankyou foryour reply ,, i did ring up to ask for a MR and they told me like yourself to write to them within 4 wks of lettter ,i also asked for the assesment report and the lady i spoke to sais she would request that for me asap.. this morning however ive recieved a txt msg of dwp stating they have recieved my request for MR and there is no need for me to contact them as they are lookig at it now ,,. ,not sure what to do now as they havnt given me a chance to send letter and this will probably resut in the same outcome now ime supposing ,
any advice would be appreaciated ,.

do appologise for my posting ,but i just joined the site and find it very confusing as ime not very computor literate,and have managed to store this to favourite now so wont post on any other forums,. ,i have read your replys,but cant seem to find the answer to my query, basicaly on the 3rd of recieved my pip saying i wasnt entitled to any of it ,so i rang them and was told i had to write to them within 4 weeks of recieving the letter , i also asked for assesmr=ent report to be sent to me , ,this morning however i recieved a txt msg , 6th june ,, saying that i need not contact them as they have recieved my request for MR and are looking at it now ,,, what i needed to know was basicaly do i still send the letter by post as i was intending to do ? even though they have txt me today saying it is being looked at now ,,

To find your posts just click on your name wherever you see it, with the exception of when it is actually in a post, so you name will be to the left of the post you have just made, click on it to see a list of your recent posts and then any message in the list to see it's contents.
The text is standard, just ignore it and send your MR request.
